A new federal court filing from Manhattan District Attorney Cy Vance as part of an effort to obtain President Trump\u2019s tax returns suggests that Trump is the target of a deeper probe by the prosecutor into potential bank and insurance fraud.<\/p>\n\n\n\n

The filing seeks to dismiss a lawsuit by Trump\u2019s attorneys that alleges the prosecutors are overreaching and acting in \u201cbad faith\u201d in their attempts to subpoena Trump\u2019s personal and corporate tax documents.<\/p>\n\n\n\n
Vance\u2019s office calls the lawsuit \u201cbaseless\u201d and casts it as an attempt to \u201cdelay the grand jury\u2019s investigation.\u201d<\/p>\n\n\n\n
The filing notes the lawsuit\u2019s claim that the subpoena is overbroad \u201crests on the false premise that the grand jury\u2019s investigation is limited to so-called \u2018hush-money\u2019 payments made by Michael Cohen on behalf of Plaintiff in 2016.\u201d<\/p>\n\n\n\n
While the filing claims that Vance\u2019s office \u201cbears no affirmative burden to justify the breadth of the Mazars Subpoena,\u201d it nonetheless points to public reporting that it says \u201cestablishes a satisfactory predicate for the Mazars Subpoena.\u201d<\/p>\n\n\n\n
The filing cites a Washington Post<\/em> article written by David Fahrenthold in March 2019 detailing how Trump reportedly sent \u201cdeeply flawed\u201d documents over-inflating his net worth to apply for loans and insurance premium reductions, make business deals and boast to journalists.<\/p>\n\n\n\n \u201cAs this reporting makes clear, at the time the Mazars Subpoena was issued, there were public allegations of possible criminal activity at Plaintiff\u2019s New York County-based Trump Organization dating back over a decade,\u201d the filing states.<\/p>\n\n\n\n Vance initially subpoenaed Trump\u2019s accounting firm Mazars USA in August 2019 for Trump\u2019s tax returns. The probe was initially believed to focus on \u201chush-money\u201d payments made by Trump fixer Michael Cohen to adult film actress Stormy Daniels. Trump\u2019s lawyers have attempted to argue that a sitting president is immune to a criminal investigation, but that argument was soundly rejected by the Supreme Court in July, which sent the case back down to a lower court for further argumentation.<\/p>\n\n\n\n \u201cWhat the president\u2019s lawyers are seeking here is delay,\u201d argued Carey R.
