Similarly, when Kwam 1 was accused of misconduct onboard\u2014an act punishable under Section 459A of Nigeria\u2019s Criminal Code Act for obstructing an aircraft\u2014he was handled with restraint and accorded dignity.<br>\u200e<br>\u200eBy contrast, Comfort Emmanson\u2019s encounter with Ibom Air turned violent. Witnesses say she was forcefully restrained, stripped naked, and filmed by bystanders. Disturbingly, the footage later circulated on social media, a development the lawyer condemned as \u201cgrossly dehumanising and a violation of her right to dignity under the Nigerian Constitution.\u201d<br>\u200e<br>\u200e<strong>Vicarious Liability and False Imprisonment<\/strong><br>\u200e<br>\u200eArchibong emphasised that airline crew members are not legally empowered to arrest passengers, citing the principle of vicarious liability, where employers may be held responsible for wrongful acts committed by their employees in the course of duty.<br>\u200e<br>\u200e\u201cThe act of an air hostess physically blocking the exit to prevent a passenger from leaving constitutes false imprisonment,\u201d he stated. \u201cIf there was an issue of misconduct, due process should have been followed by alerting security personnel on ground\u2014not by physically assaulting a passenger.\u201d<br><strong>\u200e<\/strong><br><strong>\u200eTrigger and Legal Context<\/strong><br>\u200e<br>\u200eWhile acknowledging that Ms. Emmanson reportedly yelled, slapped, and exchanged words with airline staff\u2014a possible misdemeanor under Nigerian law\u2014Archibong noted that Ibom Air\u2019s reaction was disproportionate.<br>\u200e<br>\u200e\u201cThis was not a violent hijacking scenario,\u201d he said. \u201cIt was a case that could have been de-escalated professionally. Calling it a \u2018citizen\u2019s arrest\u2019 does not give licence to violate a person\u2019s fundamental rights.\u201d<br>\u200e<br>\u200e<strong>A Pattern of Conflict in Nigerian Aviation<\/strong><br>\u200e<br>\u200eThe lawyer further observed that Nigerian airlines have faced a string of publicised conflicts with passengers in recent months, raising concerns about staff training and crisis management.<br>\u200e<br>\u200e\u201cIbom Air failed to exercise professionalism here,\u201d Archibong concluded. \u201cIf the passenger had been the daughter of a prominent political leader, we would not be discussing this in the same way today.
