ABUJA, Nigeria (FN)<\/strong>, A Federal High Court in Abuja on Monday dismissed a suit filed by Air Peace Limited seeking to block the Federal Competition and Consumer Protection Commission (FCCPC) from investigating complaints over unrefunded ticket fares and canceled flights.<\/p>\n\n\n\n

Justice James Omotosho ruled that the case \u201clacked merit,\u201d faulting the airline for attempting to use the judiciary to shield itself from regulatory oversight. He held that Section 148 of the FCCPC Act empowers the Commission to investigate consumer complaints, refer them to relevant regulators, or dismiss frivolous petitions.<\/p>\n\n\n\n

\u201cThe plaintiff must comply with the summons to appear before the FCCPC,\u201d Omotosho said, adding that Air Peace\u2019s claim of denial of fair hearing was premature since the airline had refused to honor summons unless complainants\u2019 identities were disclosed.<\/p>\n\n\n\n

In 2025, Air Peace sued the FCCPC, arguing the Commission had no authority to unilaterally investigate consumer complaints without referring them to an industry regulator. The airline also demanded disclosure of complainants\u2019 identities.
