A Lagos High Court in Ikeja has ruled in favor of a US-based doctor, Dr. Ngozi Doris Uche-Okonkwo, in a land dispute case, awarding her N5.5 million in damages. The plaintiff, Dr. Uche-Okonkwo, had sued the defendant, Oshin Emmanuel Emmanuel-Omole, over allegations of trespass on her land located at Plot 22, Block 4, Alausa Bus Stop, Oregun Industrial Estate, Ikeja, Lagos State.
The court, presided over by Justice O. A. Ogunbanjo, held that the defendant had trespassed on the plaintiff’s land and therefore awarded damages in favor of Dr. Uche-Okonkwo. The court also ordered the defendant to pay the sum of N500,000 as the cost of the action.
Dr. Uche-Okonkwo had approached the court seeking an order restraining the defendant from further trespassing on her land. She also sought damages for the alleged trespass and cost of the action. The court, having found the defendant liable for trespass, granted the plaintiff’s prayers and awarded damages accordingly.
The case highlights the importance of property rights and the need for individuals to respect the ownership rights of others. The court’s decision serves as a reminder that trespass on another person’s property is a serious offense that can attract significant penalties.
