ABUJA, Nigeria (FN), A Federal High Court in Abuja on Monday dismissed a suit filed by Air Peace Limited seeking to block the Federal Competition and Consumer Protection Commission (FCCPC) from investigating complaints over unrefunded ticket fares and canceled flights.

Justice James Omotosho ruled that the case “lacked merit,” faulting the airline for attempting to use the judiciary to shield itself from regulatory oversight. He held that Section 148 of the FCCPC Act empowers the Commission to investigate consumer complaints, refer them to relevant regulators, or dismiss frivolous petitions.

“The plaintiff must comply with the summons to appear before the FCCPC,” Omotosho said, adding that Air Peace’s claim of denial of fair hearing was premature since the airline had refused to honor summons unless complainants’ identities were disclosed.

In 2025, Air Peace sued the FCCPC, arguing the Commission had no authority to unilaterally investigate consumer complaints without referring them to an industry regulator. The airline also demanded disclosure of complainants’ identities. The FCCPC countered that it acted lawfully under the FCCPA 2018, citing Sections 32 and 33, which empower it to summon companies and impose sanctions for non-compliance.

The ruling echoes earlier judgments affirming FCCPC’s oversight powers. In 2023, the Commission investigated several airlines over delayed refunds and cancellations, leading to fines and consumer compensation. In 2024, another Nigerian carrier lost a similar case, with the court again backing FCCPC’s authority.

The FCCPC welcomed the ruling, calling it a victory for consumer rights. “This judgment reinforces our mandate to protect passengers from exploitative practices,” a spokesperson said.

Policy makers praised the decision as a step toward strengthening Nigeria’s consumer protection framework. Aviation stakeholders noted the ruling could set a precedent for stricter enforcement against airlines that fail to honor refund obligations.
